Hi,
I tried to search for this and could not find anything.
When dealing with 485 portability using EAD (with approved I140),
what happens if your underlying LC is a location/region/state bound and you end up moving to out of that specified region.
Job duties/job code can stay similar with probably salary increase.
Does the location violation get equated to unequal/dissimilar job duties resulting in 485 denial?
Chances are that should I have to invoke AC21 portability(due to layoff or something alike), I'll be facing this so I just want to be prepared for possibilities.

Guys,
I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.
I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???
Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???
greatly apppreciate any inputs....

I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

Hi Folks,
My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

I think you can do that as long as the other H1B's were not cancelled.

I'm concurrently filing 140 and 485 at NSC (my application shd be out in 2-3 days). I've obtained a waiver and my J-1 expires next year Aug 2008. What do you guys feel that if this much time is enough to obtain the decision regarding those two applications. I'll be getting my and wife's EAD in 3 months. Should I used EAD after my J-1 expries or else I move to H-1 a month before it expires. Presently my wife is working in a private company (j-2 EAD). My lawyer discouraged me by saying that my applicaation could be rejected as J-1 is non-immigrant intent visa?? Please reply...

I have 2 clarifications
a)Anyone has a clue on what an Employment Development department letter means? Is this the same as the 45 day acknowledgement letter from DOL?
b) In the absence of an 45 day acknowledgment letter from DOL, how else can we get a confirmation that our case has been filed with DOL. As per our company Attorney DOL is not issuing the 45 day letter. Can I ask for a screen shot. I saw some threads on that.. How do I ask for a screen shot of my case ? Any specific procedure? What is the response time for receving the screen shot? Do you need to specify a reason for asking screen shot?

I am currently 29 yrs old. I have had my green card for 9 years now. However, I was arrest when i was in college at the age of 20, was convicted of a misdemeanor account of drug possession. Youth and stupidity some times does go hand in hand. :mad:
My question is this, should i apply for citizenship next year, GC expiring 2010. Or should I just extend GC. I have stay out of trouble ever since, not even a speeding ticket. I have turned my life around and currently a home owner. :rolleyes:
Does anyone know any case of a successful naturalization of a drug case that was none marijuana related? Any advice is greatly appreciated... thanks in advance!!;)

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

U.S. Customs and Border Protection has announced new fees for persons seeking authorization to travel to the United States under the Visa Waiver Program. The authorization is obtained prior to travel through the Electronic System for Travel Authorization (ESTA), and typically remains valid for two years. Beginning on September 8, 2010, the ESTA travel authorization will require a valid credit card for payment of a $14.00 fee. The purpose of the fee is to finance efforts to promote international travel to the United States, and cover operational costs associated with running the ESTA program. Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.

Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

Can I work with different employer without my sponsor company knowing about it? I have a EAD and I can change jobs(180 days is over). Now planning to start a company/to work on W2 with new company. I want to use the medical benefits from sponsor company(withought quitting the job).

Hi,
I have two H1bs. I was working on first H1 till 02/2007 , i moved to second H1from 03/2007 . I am planning to go back to my first H1b which is valid till 03/2008.
Is moving back and forth on these two valid H1 is possible? If so what steps i need to follow.
