Hi All,
I need some advise on my situation.
I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.

HI Gurus,
I am working in Job A and my GC was filed for Job B by my current employer. It has been more than 180 day since my I-485 is pending. Is it possible that I switch employers using AC21 since I have worked for my sponsoring employer for 180 days but in different job. I will appreciate your feedback. Thanks

If PD is current when USCIS starts processing the applications, PD's doesn't matter. But if PDs retrogate (which will be the case most likely), then USCIS only going to process the applications which has PD current that time. I hope it makes sense.

Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

Hello,
My wife's Advanced Parole document has wrong date of birth. Her EAD card too had wrong DOB; we have sent it back to USCIS. She's planning to visit India next month. She has a valid H4 visa stamp.
Is it ok for her to travel to India? Do you see any issues while coming back.

I am planning to travel via BA from DC to Bangalore and travel back from Bangalore to DC through Lufthansa.
I have my AP doc. I know Lufthansa is fine with an AP while I travel from Bangalore to DC visa Frankfurt.
Will I need a transit visa to travel through London to India (one-way)? I have a valid Indian passport and am on Advance Parole.

Recently my 140 was filed and the checks were cashed through ACH. I paid for PP and see that the checks were cashed on March 8th. My attorney has not received my receipt, I was wondering if there was anyway I can get the receipt number for the case so I can track it ...

How quickly can we change the job safely after receiving a GC?

Dear attorney,
please help me understand my problem.
Through company A , My I 140 has been approved and have my 485 filed too ( i do not have the receipt number or the approval letter for the 140). I am still using the H1 from Company A
Can i move to Company B, on H1 transfer file Ac 21, and have perm and Labor approved through company B and then port the date of company A priority date
Without me having a proof of 140 approval will it be possible to port to the earlier date.
Or should i have company B file labor and 140 as a future employer have 140 approved then port it and move to employer B.

I currently hold H4 visa. I got H1 approval (consular) this year. Now instead of applying by consular process (in London), I want to join my spouse on H4 and then apply for COS from within USA.
1. Can I do this?
2. If Yes, how? Which form do I have to fill ? Kindly detail the procedure with applicable costs.
3. When I later, travel outside US, do I then have to have H1 visa stamped in my passport?
4. If Yes, does this 1st visa have to be from home country or could be from Canada etc.?
P.S. I do not have any educational or work background in USA.

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

My I-140 (National waiver approved, no labor required, self-petition) is approved, both me and my wife are working on EAD. Have valid AP till Oct 2009. 485s filed July 2007.
Today, on 10th, my wife (dependent 485) got hard LUD, "request for evidence notice sent" is the update.

The RFE is for absence of child's name (my wife) on the birth certificate. They wanted another birth certificate, hospital document or religious record or civil authority record that shows her name and both the parents names. They gave us 90 days time.
