Dear Experts,
My wife's H1 is pending from H4. Its got selected in lottery and waiting for approval. But in the mean time we have to go to Canada and come back within 3 days. I would like to know if this impacts the COS. If it so, what are the options, means again can we apply for COS once we get the H1 approval without COS? Please let me know the options.

If I were you, I would definitely call them or take an infopass to be aware of the current status. That way you can have a chance to know if there is something wrong and you can address that immediately.

Hi,
I have my labor certiifcation approved and currently filed for I-140.
I-140 is not approved yet.
I have an offer from another employer with very similar job profile.
My 6 yrs of H1 is getting over in 2010 summer.
My prioriy date is Dec/07.
What are my options
1) Can i change a job and keep same priority date(as job profile is very similar)
2) Do I have to start from zero again?If yes,how much time I have to get priority date assigned again(considering my H1 bgets over in 2010 summer?)
I will appreciate your comments

This was inevitable. As Chris Hayes of The Nation told Keith Olbermann this evening, a boycott could "recalculate the incentives" for the citizens of Arizona and the politicians in the state. Once Super Bowls and major conventions start to go elsewhere (as was the case two decades ago when a similar boycott was successfully used to protest the state's failure to recognize the Martin Luther King holiday), the cavalier anti-immigrant positions will become a lot more expensive. I do not think, we need to break our head against House repulican, they are so bias in their thinking and approch.
I think, senate version will have some chance of incorporating SKILL bill, since they are usually broad minded and willing to listern.

That would be 245(i) - ability to file for AOS with more than 6 months out of status by paying a fee. Most people here would be opposing this ammendment because of some "moral" issues. Well, I hope they have never been out of work while on H1.

In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

I am on H1 Right now and through the same employer i filed my GC in May 2007 (I-140 approved in Oct' 2007)
but I have got an offer from another company who is willing to transfer my H1, so wanted to know what is the best options.
- Should i Switch on H1 and if yes, can i start working for them before the H1 Transfer process is complete
- If I did decide to go on H1 then do i need to file some documents for my I-485 and EAD Renewal as well (meaning do i have to inform USCIS about my change in employer for GC application)

My AP approvals are lost in mail, my employer mailed them in ordinary mail during holiday season (12/11/07). What can I do next? Go thru attorney for duplicates? Please advice.

I entered US on H4. Then applied for H1 for software job. worked for 2 months last yr and then went for maternity leave.
Now I started working again and I still have to go for stamping.
I have completed CPA and I would like to move to an accounting firm ( they have to file my H1 transfer with accounting domain).
Is this going to cause any problem during H1 transfer or stamping??
Please advise me...

Interesting question. SOmeone recently asked me the same thing. She came to US on H4 and is having a h1b being done by a body shopper as a QA tester in IT, but she is actually a pharmacist and would like to get a H1b transfer if she finds a good pharmacy job.
I am not sure how h1 transfers work in case it is different profession.
I guess they should work fine because people can have multiple skills, some people gain skills over time like say, people do MS or MBA while on h1b, and then apply for a different kind of job and get a transfer.
Gurus must be able to answer this question.
