i was in same situation. my wife's AP was approved and mine not, before leaving US, so i went for h1 stamping but, my wife didnt. on return, i entered on H1 and she entered on AP.
SFO port. they asked her to go to secondary inspection room, had to wait for 1/2 hr. they called her name, no questions asked, gave her docs back. we both were in.
this was back in Feb'09. i work directly for F100, popular company.

Hi,
Can someone tell me a little bit about visitor visa validity dates. For eg: if my parents got a 3 month visa, is it valid from the date it is issued or from the date of entry into the US?

It is valid from the date it is issued and they shld enter the US before it expires. However at the port of entry, the consular officer may chose it give it beyond the actual expiry date.

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.

Today , an officer from Homeland Security visited my office.
The guy showed his Identity Card and was looking for me and the my boss (who signed the Visa Papers). He took me privately in a conference room and asked me questions like my pay, my duties, who paid for H-1 renewal etc.
Then he went to our HR dept and asked a few questions regarding my employment history. He asked me if you are treated well in this company. ( Note: Mine is not a consultant company) Anyways the guy was very polite and he told me its just a formality from homeland security
also he took picture of my desk
On searching more on this I came across this site

Hi,
I recently got 3 year extension on H1B. I am currently in 8th year of H1B extension. All previous stamping were done in India, I have following question regarding the Visa stamping in Toronto-
Can I get my stamping done in US consulate in Toronto.
Where (Link) to take an appointment for stamping.
List of the documents required.
Anyone who has done it before, Please help

you are right buddy. My husband was telling me the same thing today. If they can do what they did today, they are capable of pulling any tricks on us. I have also lost trust in this system. I am now more scared than ever for some reason.

I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.

Hello All,
My checks got deposited on Friday and when I checked my wife's I 485 status with the LIN # on the back of the check, it said that the finger printing fee was rejected and that the case is now in suspense.
It said that I have to submit a new fee and that the case will be resumed again.
Do you know why this happened. My bank statement says that the finger printing check for her got deposited.
So if there is a mistake in the check, would they still deposit it ? And would her EAD application get processed even if the finger printing fee is wrong ?
Did this happen for anyone ?

I am in a confusing situation would really appreciate some suggestions.
I am the primary applicant and my spouse is the beneficiary for the 485 applications that were sent on July 07. I have received a RFE on my 140. My PD is 12/2004 EB3-India.
My spouse company may be willing to apply for her under EB1C. I have a few questions:
1. Can she apply for 140/485 simultaneously? (I heard concurrent applications are not possible)
2. Can the existing 485s be jeopardized by the new 485s?
3. Do we need to go in for FP and do our Medicals again if we apply for 485s again or are they going to reuse what we have already sent?
4. Do we need to withdraw the existing 485s at some point of time
5. Is this worth the hassel of complicating the applications?

You can even take an unpaid job/volunteer to keep you clear of the 90 days unemployed clause.
I didnt know that even the OPT rules have changed now. This is a mess.
Now OPT also you cant remain unemployed for more than 90 days. Now this OPT is becoming like another H1B.

My GC was applied with employer A in Nov-2005. 485 applied during July 2007 fiasco. Even though I have EAD/AP, I have always maintained H1B status.
Recently got H1B transferred to employer B and its approved for 3 years.
My H1B visa (from employer B) will expire this month.
Can I make a trip to India and re-enter using AP, and still maintain H1B status?
I dont want to go through the hassle of going for H1B visa stamping for 10th to 12th year.
