PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

Hi- I'm e-filing my I-131 and it is asking where my I-485 is pending? How do I find this information? The cases status online does not give away this information.

Look at first 3 letters of your i-1485 petition. If it is:
EAC - Vermont Service Center
SRC - Texas Service Center
WAC - California Service Center
LIN - Nebraska Service Center

In Section , it was written as "Sec. 203 (b) (3) (A) (i) or (ii) ".

I have been in H-1B status for 4+ years. This year, I started attending full time college and had applied for transfer of status from H-1B to F-1. However, my application is still pending with USCIS. Since I need to travel home urgently, I was wondering what steps should I take before leaving so that my status is not affected. Because if I travel abroad, I will be applying for new F-1 at a US consulate, do I need to cancel my application with USCIS here before leaving? Are there any consequences of keeping my application pending here.

Hi,
I have applied for H1B extension for 3 years based on my I 140 approval. I have submitted all relevant documentation except for client letter.
My current H1 expires in Oct and we are expecting our baby in October as well. I would like to know what would be my options in case my H1 extension in denied. I cannot leave with the new born atleast untill december (need time to get passport n visa for the baby) and I wouldn't want to get into any legal issues like staying in US n not being in status.
Looking forward to your advice and suggestions

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..

Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

Out of the 65,000 cases that can be approved for H-1B this year, 37,400 cases have been receipted by USCIS for the regular Bachelor's degree H-1B quota. This is up from 36,600 cases which were received since September 3, 2010.
Approximately 13,700 cases have been receipted by USCIS for the advanced degree H-1B quota, a slight increase of about 300 cases filed since September 3, 2010 when approximately 13,400 cases had been received.
October 1, 2010 is around the corner. People with newly approved H-1Bs will soon be able to begin employment. First time applicants can still continue to submit applications for H-1B status until the entire H-1B quota is exhausted. I'll keep you updated on the cap count, so check back soon. ---ecf

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.

could she come in as a tourist and have a school accept her in Houston Texas, then change the status into student using I-20 issued by the school?
how long it will take to have the status change? more than 2 months?
Do I have to get an immigration lawyer to do it? Or could I do it myself? If yes what is the form number?

Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

It may be time for a day of research. I'll be doing something similar in the near future, and my plan is to sit down with a cup of coffee, the yellow pages, and my phone and call the photographers in my area and ask them each that same question. I'll make a chart and put names to prices.
Where you have an advantage over me is that your town's population is about 32,000 whereas I'll have to do this over the entire metro area where I live. Ughh!
