trouble is that labor certification is not explicitly mentioned in 406 (although that seems to be the intent). Besides, section 405 says that those with "advanced degrees" in STEM and who have been employed on NIV can directly apply for change of status subject to per-country caps .. then again there is mention of a special labor certification process for those with advanced degrees. So i think the conclusion is that while labor certification wont be done away with , there will be special handling for those with STEM degrees .. and those with 3+ years experience AND STEM degree wont be subject to per-country limits.Again, lots of ifs and buts in the whole thing .. we will have to wait and see.

EAD is issued to ALL 485 applicants based on pending I-485. As far as I know, "pending Adjustment of Status application" is the only criteria for 485. That means both the primary applicant and the spouse will get EAD irrespective of whether dates stay current retrogress as long as you applied for I-485.

This is really a very disappointing news. However, now we all know clearly that our issues are closely related to illegal alliens. We are on the same boat as that of illegals. CIR will probably take forever to happen. Maybe 2 to 3 years if we are lucky. My PD is just 3 months away (China EB2). I guess my PD will become current within 2 to 3 years even without immigration reform. I would not put my hope on this immigration reform now. I will just plan to wait for 2 to 3 years. It's kind of a relief for me.

we should not care whether it can be done as part of admin fix or legislative fix. Since it has come Straight from the horse's mouth (DHS secretary), I think we should bring enough attention to her to push for this fix.

I saw the danger of our time and effort being sidetracked by trying to argue whether it's a legislative or administrative fix. The new secretary has made it clear that she is willing to push for BOTH Administrative AND Legislative fix if it's deemed necessary. Our goal should be bringing enough attention to her on the pre-application issue and convince her it's a meaningful change that will help both the DHS and the applicants, so she will push for changes. AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.

You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!
In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive.
