I think the answer is Yes. The primary applicant can be on H1 and the spouse can be on EAD/AP.

I recently sent a letter to the USCIS Director Explaining the problems faced by H4's because the stay in H4 counts towards the H1 time. Just to bring up the matter of Decoupling H1 time and H4 time. May be it was long forgotten in the bureaucracy.
I couldn't find an email address of the USCIS Director, Not even a full Address.
I used the address below. It might reach there or come back to me.
If it reaches there and if I receive a response I will post it.

Let us hope the decoupling memo will be out... Or better the H4 get allowed to work as the L1s.

I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.
Plus you children will also have option of deriving Candian citizenship from you but but...

This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
Unless there is a real need, moving from EB3 to EB2 dont make much sense.
Do not agree with this. This is not a fair analogy.
Nobody is saying IV should stop efforts for administrative and legislative fixes.
If someone has an option to switch to EB2, he/she should definitely try it.

I m in simillar situation as you are.
Transefered to new employer : Filed Ac 21,G 28 , H1 Transfered to new company through corporate lawyer
Even received EAD and AP renewals last week.
Today I have received deniel notices for me and my family applications.
Thank God I did not use my EAD so far.
Dont know what to do? It is so frustrating.
No NOID also , they sent deniel directly as your case.
Please post if you have received any updates.

Checked with my current attorney and my old attorney as well but they have not received any notice.
Can you tell me which date you received email and how many days it took to get notice in hand?

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.
I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.
A few min later my spouse called and they told her, Everything would be rejected.
USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.

Iam sorry to say that i could not navigate to certain forum postings and IV did not communicate that these are not availabe for Non - Donors.... Why this caste system?

I am so sorry that IV did not inform you about Donor forum. I will check with IV on why you were not notified earlier. This is clearly unacceptable. IV core should give up their jobs and should start going door to door to inform everyone about IV's goals, strategies and changes to policies.

i think if we are paying for something we should have the ownership it too.
lets format a reply saying that 5K is too much for the job...if they can give us their Data Model diagram, we can give them the code in a week without any cost.

Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

I have really had good experiences when i renewed my passport, my wifes passport and also when i applied for my childrens PIO card. On each ocassion the documents arrived before time and the service at the SFO consulate was great when i called them with a concern. On all 4 ocassions i use the $20 option to get the document by Fedex. We spend thousands on the recurring nightmare at USCIS, $20 for peace of mind is not a big deal.
I have also observed that we tend to get overly agressive when we talk to indian govt officials here. I think we expect bad service and we mentally prepare ourselves to fight. I am not saying that all do this but some of my friends did concur with the thought. There are many geuine cases where there is a problem, as some desi govt officers are sticklers for making sure that forms are in 'order'.:D

I mailed 2 letters and somehow I dont see my name, i just want to make sure IV got my letters from Ohio
