If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.

I agree with this. At Cornell, the cost is 90K, and then on their website, they say something like this: after getting our MBA you are ready for anything!

A lot of hard data shows that that is anything but the truth. That kind of money can be spent in buying a house for instance or something that is much more worthwhile. Nowadays, there are jokes about MBAs not being able to open a pdf document.
 
But I must add that after you've spent 10-15 years in industry, and you want to climb the corporate ladder, an MBA from Harvard or Sloan (or the very few top schools) will definitely help. The returns fall drastically as the rank of the school falls. Surprisingly, the fees don't fall that drastically, and that's why one has to be careful.
 
As far as ranks, created by US News etc, go: here is the thing. Arizona State is ranked in the top 50. But does it have the same reputation as MIT? No. So even if the ranking is in the top few, make sure the reputation is truly high. And that means three or four schools: Harvard, Wharton, Sloan ...

is UNLIKELY to pass at least in its current form. Public hospitals, underserved area clinics, Universities are not Google and Oracle!!! They'll go under if they have to pay 5000 $ for H1Bs. People probably don't have the faintest idea under what kind of financial strain these are. There will be exemptions for universities and non-profit organizations.
 
Not only the 5K filing fee , One have to do newspaper advertisement like PERM the cost of lawyer fee and I read somewhere One year extension for H1b beyond 6yrs since I140 will be out of the picture. :eek:

Berry, Appleman & Leiden LLP is very good firm. I have very good experience with them. They completed all my paper work on Jun 30, so that they can file by July 2. Also the attorney and the para-legal were really good and replied to my questions patiently. The website is http://www.usabal.com/

My PD became current on June. I asked them repeadtly to file my 485. And I asked them for like 1 1/2 month. But they waited till July to file my case. So, I was affected by this visa fiasco. Their lawyer do not answer phone calls, they don't return voic mail and they do not response to email for 3-4 days. It is a totally BS firm. If possible go with small immigration law firm.

Good to know you are pursuing a part time MBA. For people stuck inthe GC dilemma, further education is really a good oiption.
 
For folks around Philadelphia, if you are looking for a good part time programs, Wharton Business school is offering evening programs (Certificate) for Working Professionals. For me it was really a good experience doing the program.

Here is what me and my wife are doing. When the retrogression first hit us in 2005 January we were both devastated even more so because one my friend and his wife, with same the same priority date as ours and similar EB3 RIR got the Green Card on 24 Dec 2004. We would not have been so frustrated if they had the priority date even a month or so before us. But some are just lucky I guess. Coming back to what we are doing. My wife started her masters and finished in May this year. She could have finished in December but we were really banking on the CIR in May so she took more courses and finished it faster. Well that did not happen so whats next. So now I will be starting school again for second Masters this time MBA from one of the top10 B schools in January 2007. Ideally I wanted to do Full Time because its shorter duration as compared to part time but GC God (I wish there was one like that so that I can do the "Nariyal Pooja" or "Mundan" or "Abhishek") had otherr wishes so I have now switched from full time to part time. Lets see if my part time MBA of 4 years wins the race or Green Card wins the racce against time.
Moral of the story. Channelize your energy into something positive and get masters or second for that matter, or learn a new language, enroll in classes to learn languages that run for 6 months at community classees by the time you get your GC you will know atleast a dozen languages.

If bill is passed Senate in 2007 it will pass current form for H1b. There is possiblity for failing of the bill is 75% now. Also even if Cantwell amendment is passed that will give relief only to high tech companies not for Hospitals or Health care. There is no other amendment other than Cantwell for H1b or GC relief in Senate
Only unknown is how House will handle. Now house is confident that Senate will not pass CIR(Infact house members think they can escape from this hot button issue)
 
But I am almost certain that Most persons who file I485 within next 6 months will get GC within 1 to 5 years whether CIR is passed or not.

Main reasons for restrictions in legal immigration are
1. Organised compaign by anti immigrants with data. They proved that H1b persons were paid 20% below the market rate. There is no defence from orgainised compaign by pro immigrants. Pro immigrants gave the statement that shortage of skilled workers but they were not able to give supporting data. Newspaper stories are not enough
2. Reaching h1b cap in 2 days gave negative picture instead of positive. Mostly consulting companies rushed to get h1b without valid job positions
 
3. Instead of asking reasonable numbers Corporations and pro immigrants asked exemptions in H1b numbers and green card numbers. They want to make sure that unlimited numbers so that they can hire or fire anyone.
4. Immigrants are suffering by backlogs and they are expressed by IV and Lawyers. But that is not enough to justify immigration. That should be justified with real need for welfare of country
5. Before dot com bust even lot of US citizens welcomed H1b persons as there was not much layoffs. But past 7 years layoffs increased to outsource to India,China and other countries. For that they have to hire H1b and L1 persons from Countries mainly India. Those things made anti immigrants hardened their stand. US workers fear that they may lose job if US opens up immigration too much.
6. Some Indian consulting companies exploited the situation by just hiring H1bs not even trying to recruit US workers even if they available. But some Indian companies like TCS,Infosys started hiring US workers nowadays because of shortage of H1b.
 
H1b persons are considered as best skilled persons so Companies can afford to pay 5000 or even 10000$. Infact H1b persons should be paid 20% above US workers as they are considered as better than US workers. That is the reason for raising the fees by two thirds of Senators
 
Microsoft was doing effective compaign. Infact they asked resumes from programmers Guild. If many people do realistic campaign instead of opposing anti immigrants that will be easy to reform immigration
 
 
I am sure that the tech lobbyist are going to change the rules applied to the H1-B process, because everyone knows the effect of this to the econoomy. I am totally convinced that the strict H1-B rules will be removed.

How important is EB relief for them?
 
1) they can't hire brains from US universities.
2) they can't hire those who they think would benefit the company but are stuck with their GC process with some other small consulting firm.
 
I see STEM with advance degree getting relief, the current backlog will not be benefitted a lot (eg. Real hike in EB visas, Removing the country cap). I am not being a pessimist but, I do not see a light in my path. (May be my comments are wrong)

After the State Union Speech given by the President to change the Immigration system, we saw a huge applause by all the law makers. So many individual bills in favor of Skill were introduced. Mr Gates, in front of Senate gave a detailed explaination of our problems, we saw few bills after H1-B quota ran out on the second day of the filing date added to the senate judiciary committee.
Our hopes increased after seeing so many favourable documents and media coverage, but what happened in the end.. Illegals were given a very very very easy path to citizenship after breaking the law.They get a relief which we can never imagine will ever happen to us.
 
Let us say we get the oppurtunity to file I-485 without PD. Increase in H1-B, Increase in EB visas. But still we have to stick to an employer, can't move up the ladder because of the same Labor description needed to be mainain I-485 if we take AC21.
 
I cannot digest and will never be able to digest that we are not given the oppurtunity to file our I-485 individually and work for any employer.

BIRTH CERTIFICATE FROM CONSULATE IS NOT ACCEPTABLE. YOU HAVE TO GET ONE FROM YOUR HOME COUNTRY OR GET AN AFFIDAVIT FROM PARENTS OR RELATIVES.
 
Maybe one can get a birth certificate from Consulate General of India here in the US ?

This clever trick isnt going to work forever. I understand a lot of you have already spent 8-9 years here waiting for a GC, but fresh H1-Bs like me fully know what the situation is and are mentally prepared with alternative plans for career advancement. Our strategy is to save like ants while here, make mimimal investments, apply for a GC and wait. If no reform is forthcoming, we will give up on the US as a long term option and head out much before we give the prime of our working careers to a dead-end job in this country. 
 
If a majority of the H1-Bs do that, what will the tech companies do ? They will be forced to send more jobs to our home countries. Come on, you cannot do all your work with fresh-off-the-boat H1Bs .. experience will always be needed. If they cannot get those experienced folks here, the jobs will simply go where we are (and will get done for an even lower price of course).It is already happening; retrogression will only accelerate it. Such a situation effectively amounts to training foreign workers, paying them and sending them home. It is a no-brainer who the real loser is in such a bargain : yes, it is us in the short term, but ultimately the US economy will pay a price.
 
Current immigration policy is based on the assumption that our home countries will forever remain poor, and the US will have a never-ending stream of smart, hard-working people desperate to settle here. In a globalized world, that is fast becoming outdated.Sooner congress realises the better.
 
 
Let us fact it. We need GCs and we have waited for x years. Now that only seems to be illusion that may happen some day, many years from now. Have we contributed to this country. Yes in many folds.
Will the US govt provide relief. Probably not. They will certainly
raise H1bs as they need more contributors to SS. All this SKIL etc is just to keep us going for a few more years. After a few more years, many will give up, but get used to living the way we live now. We just wont have the energy to complain. After a while it is human nature, at least in most cases to accept. If we accept we will continue here hoping, some day GC will happen. I believe the majority will fall into this category. There maybe a few who will leave. But then there will be thousand more new H1b coming in to do the work, chasing the GC illusion, contributing to SS, buying cars, paying rents keeping the economy going. The lawyers will make money. Employers will get indentured workers. The economy will benefit from their productivity. So all concerned except you and me will be OK.
 
 
They understand the circle of life better than you and I do. It is about time we understand this. Once this sinks in, we will make the right choice, whet ever that maybe.

Please do not confuse with IV objectives with the Posts with someone who is not part of core team. IV's objective is always getting MORE visa numbers. 
 
All these Horizontal vs Vertical etc all USCIS/DOS created issues. Whoever is benefiting out of this overflow, they are happy and others are not happy.
 
Last year during last quarter there was heated discussions between EB3-ROW and EB India. During that time there was vertical flow and EB3ROW got more visa.
 
If you ask me overflow should be evenly distributed based on the backlog of a specific category.
 
The % of allocation should be based on the backlog.
 
To do this USCIS/DOS should have exact detail and have a centralized process in place. Since they don't have this and changing this is not possible in our life time, everyone is trying to suggest to change to EB2.

The student visa provision on adjustment of status says that it applies to everyone who would have been in that position if the new visa would have been in place when they graduated - i.e., it is retroactively applicable. In addition it clearly says that it is applicable to students who join an accredited graduate program in STEM to obtain an advanced degree. The contrast with Specter is clear - Specter's markup clearly mentions PhDs, where Frist's bill only mentions advanced degrees. I really haven't mentioned the 1 year provision and the $1000 provision in my earlier posts. Those are givens.

Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
 
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.
 
Well...I got the mail from USCIS for I-485 RFE. Not for H1 as you thought.
 
Please note all H1Bs, F1s, visas....are part of 485 application.

Wow - Mine also went on the same day. No sign of EAD yet. I wish they handle it next week so that I get 2 years :)

I think they have different rules(for themselves) for AP and EAD. As my AP was approved for from the date of expiry....That's ridiculous. Forget abt the 2 year EAD that you didn't get, you also lost 3 months? They probably hired some part time workers for last weekend who might have screwed up. I did some research before and am pretty sure they started issuing documents with a start after expiry of the first one a long time ago. Even on our AP's which were approved, the start date was september 2008. I got them mid -may..

I hesitate every day in doing things that help them. So far I have taken temporary decisions to continue.
 
It is mentally very draining!
 
I totally understand what you are going through, been there myself! Don't mind those people, keep going and do this for YOURSELF! Yes, many people will benefit from our struggle without having moved a finger, that is sad but that always happens, in every struggle, in every issue. There are other very sad things such as the visa lottery, or the 1985 amnesty which saw thousands of people from overseas come to abuse that even if they didn't qualify, and all those people got a free ride! But you know what? They are there and they won't go away. It is our choice to stay and not go away, and we have to fight for that. Together, we are friends and family at IV. That was evident at the rally! Times may get trying at times, but we'll keep going and succeed!

My Lawyer didn't file my I-485 until July 7, 2007. He never replied to my e-mails or my phone calls.
 
My whole experience with them appeared to be as if I know more than them. It appeared as if I had to educate them about the development.
 
Considered changing lawyers and also considered filing on my own. But finally thought to ahve atleast soem attorney whom i know(at least i know what can expect?).
