I cannot agree more with all the views. I have been here for over 5 years and couldn't find an employer to change to H-1B. L1 spouses can work and if the new immigration bill is passed a spouse of an illegal (who is legalizing now) via a low skilled job could also work, why can't we? We should have anyways.
There is a bill called TALENT "Through the Advancement of Legal and Educated New Talent.” which if debated and approved would let H-4s work, how can this be done?

Berry Scheniderman, Virginia. Horrible experience. They took 3 months to file for my H1B extension and then I was running out of time so I had to get it converted to premium processing. They simply sit on the case.

Alan Heckler, (Specially the paralegal named Cathy)., takes months to respond . The only thing they are quick are at getting money. Totally unresponsive.

Under current, LLC in Chicago , takes weeks to see the paperwork that you send and weeks to process them

How about a candle night vigil outside all state capitals, one Friday/Saturday/Sunday evening? This is a symbolic gesture for the slow death of our green card dreams.

This question is not to undermine the effort, which was tremendous but just from a realistic point of view...

I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?

Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?

If the same question has been already raised, please ignore.

    Thanks.

Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.

Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change

Anyway - lets close the thread. I was hoping to get some better information about how we can improve our motivation techniques for the future. I got many answers...

I have really had good experiences when i renewed my passport, my wifes passport and also when i applied for my childrens PIO card. On each ocassion the documents arrived before time and the service at the SFO consulate was great when i called them with a concern. On all 4 ocassions i use the $20 option to get the document by Fedex. We spend thousands on the recurring nightmare at USCIS, $20 for peace of mind is not a big deal.

I have also observed that we tend to get overly agressive when we talk to indian govt officials here. I think we expect bad service and we mentally prepare ourselves to fight. I am not saying that all do this but some of my friends did concur with the thought. There are many geuine cases where there is a problem, as some desi govt officers are sticklers for making sure that forms are in 'order'.:D

Same with me (again SFO consulate in late 2004). No issue and everything happened smoothly. When I called to enquire on the status, they responded very professionally.

Again there are several factors to it. If the person recently came to USA, may be he will be much more polite and as days goes on, there true self start erupting OR its just they easily show their frustrations given there job security or could be we are loosing our respect with fellow indians as well recent times after all INS and federal governments are doing to aliens. Just my thoughts

I agree, India is a far better option.

Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.

On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.

As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.

India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

I have much better lifestyle and opportunities than Canada or even western europe! Period.

Thanks for actively participating and helping us in this effort. I'm sure we'll make this meet a success with our combined team effort.

More volunteers are welcome to join us in helping the meeting preparations. We also greatly appreciate any other help you can provide.

Members who have signed up for the meet re-confirm (basically RSVP), if you haven't already done so (after cagedcactus requested it). It will help CC in arranging snacks and tea . You can PM him or post here.

Need transportation from Lansing to Troy? Send PM (private message) to Bestin, by clicking on his id (on the messages posted by him) in this thread/forum. He has volunteered to accomodate 4 participants on first-come-first-serve basis. If you aren't based in Lansing, but still located somewhere on the way ( b/n Lansing to Troy), he can pick you up and drop you off ( if the detour is reasonable like a few miles). Don't let the lethargy to driving long distance dampen your enthusiam to particpate in an event that will affect your future.

Guys who cannot participate on 10/20 due to any reasons, but interested in future activities - PM or E-mail me. I will add you to the list of invitees for the future activities.

    Great job WD....
    Kudos to Bestin too...

We clearly see the fire burning. Now that we have seen Quality, we need to see quantity... the fire must must burn throughout the state, or there is no use... more the merrier........

I know a lot of folks are enjoying the latest arrival of EAD cards and Finger prints.... but dont kid yourselves.... these are traps.... baits for those who want it easy.... we wont have it easy.... we will have to fight.... for us, and for those who are in line.... for our families, and children....

rise people........ rise now, or never....

Understood every point of yours & I stand by what you said except for the language as it could have been a bit better. Regarding EB3 or EB2, maybe IV should work attaching a provision as part of its CIR work, which makes USCIS determine whether a candidate is in EB3 or EB2 based on the PERM & 140 instead of letting companies & attorneys mention it. If this happens the process will be much better as USCIS controls the categories & applicants do not need to beg a company to throw them into an EB2 basket or EB3 basket. Also, applicants can have certain amount of freedom from the companies.

When a process is flawed, there is always room for abuse. Of course, the abuse might be minimal, but when we see people with masters & 15 years of experience toiling in EB3 category it pains my heart. It is a fact there could be lesser qualified inidividuals who are in EB2 category, but the companies have managed to use these to hold the employees as hostage.

Hopefully USCIS someday understands this and takes control of assigning applicants into categories than asking company & attorney to mention.

Just sharing my two cents. Also, frustrations from EB3 should be tolerated by IV members, instead of beating them with "red dots". Because if we request members to put their time and effort then it would be mostly EB3 members as they are the "worst" affected. I am sure every year between july-sept most of EB2 members will do bulletin-watching & there is nothing wrong in it.

Next year by this time only EB3 will be here and I dont think many of the EB2 will even bother to read the forum. God bless EB3. Even for those guys with PD in 2003 if you think that you will be lucky in year or two, try buying lottery tickets too. You might win a jackpot.

    Good Luck guys...

Those of you who are thinking that you can write a SQL query in a snap, you are egregiously mistaken.

The CLAIMS database, which contains the AOS/485 petitions is neither a SQL database nor a modern CRM application. AFAIK, It is a legacy Mainframe system and needs significant effort and rare expertise to extract the data.

Ideally, The Country of Chargeability should be in there. But these systems were built around 92 or before and the requirements gathering probably might not have thought about retrogression or carelessly left it out. What ever it is, it is not in the electronic format, it is almost impossible to get the biographic information unless a physical check is conducted. We can cringe and cry all we want, but not a lot is going to happen on the CC

The good side of the issue is, Since EB-3 ROW is beyond 2004 and we have per country PERM data (not completely accurate, but significant), our statisticians and operations research folks will break down both data and get some thing that is valuable and accurate above 90%. We can safely assume that more than 90% EB-3 Pending before 2005 belong to I, C & M.

What bothers me is the requirement of the definition of Priority Date? You would expect some one in the CIS/NRC to know what a priority date is. Don't ya? Any ways, We are working with members who received the response to get a better answer from CIS to determine further action.

Stay tuned and we will let you know.

I think I-485 filing clause is needed. Please note that the USCIS is not staffed enough. So there is a high possibility that the priority date retrogression will continue even if all the current provisions included in the Frist bill is passed. They will retain the retrogression in order to control the number of applications. In such a scenario, it is important for us to try and introduce the I-485 clause, so that people could get their EAD while they wait for USCIS to clear the mess. My 2 cents.

This actually CUD very well happen. It may be good for IV to consider that.

    desi3933,
I completely agree what you said and what is interpreted in the law.
BUT if they really go by law , JULY 2007 fiasco SHOULD never happen.

    ......

    Read this pdf

We should focus on spreading awareness about IV. I can't believe I was totally unaware of IV's existence until a month back. I haven't done much but felt strongly about what IV's doing. Me and my wife attended the rally and even contributed for the first time ever. We should brainstorm on how we can get more people on board and on how to transform members into contributors.

Welcome! You may have seen posts from the core members about what IV is.

IV is you, each and every member. Our strength relies on each and every single thing that we do as individuals.

That being said - an excellent start is joining your local chapter. If you don't have one, you can start one and we can help!

If you have ideas on how to spread the word, let us know, we can help!

Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!
    just a thought!

login to paypal and then click on send money. you will then see a text box saying To: Enter donations@immigrationvoice.org corresponding to that. Enter the amount you are willing to contribute and click on send money. Please PM me if you need further help

Its kind of confusing to make a one time donation.. and there should be two more options of $25 and $50 for one time contribution....

Can anyone tell me how to contribute one time and for the amount not mentioned on first page..

I think we should follow Hillary and Obama's grassroot campaign, whereby asking for smaller amount and that way make people more willing to contribute in smaller amounts...

    Please read secion 10:5 - b:5

    http://www.uscis.gov/files/pressrelease/RFEFinalRule060107.pdf

svam77, I read your link. b.5 can be interpreted anyway one desires. So if we file 485 without the 140 receipt, but with only fedex proof of 140 delivery OR receipt# from check, it is completely up to the adjudicator whether to accept or deny or request more evidence. Agree?
