People were very happy with the last USCIS announcement but we all forgot about pain of people who are stuck in years of backlog. Though some of those unfortunate may have used harsh or improper language, but they had all the right to express their feelings. We all talk about Gandhian philosophy, but we need to be more tolerant. Before we ask to ban anyone from our forum, please try to put yourself in their shoes. 
 
Our fight is far from over, we should all fight for for in-justice made to people who are trapped in the bureaucracy.

Lets pay them to get info. It is a drop in a bucket to what we are spending. If they provide obvious wrong info, we can sue them to get our money back and it will have enough press coverage then. They have a right to ask money for FOIA if it requires further searching. It is part of the Law. So they are right in asking for money.

I flew from Seattle. Started 4:00PM monday afternoon and reached 7AM tuesday. left 5PM tuesday and reached home at midnight. HAd to take an unpaid vacation.
 
I had asked IV for sponsorship.
I got sponsored for a non-stop and a very comfortable flight. but it was $700. Although IV was able to collect $700 for me(thanks to abhijit), i felt it was a little too much to be spending on one person. I raised another $150 from friends and $75 from my own pocket and bought 2 cheaper tickets instead(with bad schedules) and got another friend of mine to go with me.
 
I had a choice : spend $700 of IV money on one comfortable ticket
OR
spend $75 out of pocket and hours of talking to others to contribute and get one more person to go with me and fly a weird schedule..
 
I'm proud to have made the right choice!

innovation, U.S. employers must have access to much-needed and sought-after highly educated talent �
including scientists, researchers, teachers and medical professionals. Foreign-born professionals make
great contributions to the U.S. economy and create good, high-paying jobs for all Americans.
 
U.S. employers rely on EB green cards to keep foreign-born talent living, working and innovating in
America. Yet, despite the critical importance of these visas, Congress has failed to address the well
documented backlogs in the EB green card system that leave some foreign-born, highly educated
professionals waiting over six to 10 years to receive a permanent resident visa.
 
The three bills will address many shortcomings in the EB green card system. For example:
 
� H.R. 6039, by exempting highly educated, foreign-born students earning an advanced degree in
science, technology, engineering or mathematics from a U.S. university from the annual EB green
card limit, would help U.S. employers retain these talented individuals in the U.S. workforce. For
example, foreign nationals comprise half of the master�s and 70 percent of the Ph.D.s in electrical

I think for Indian EB-3s, if your priority date is after March 2002, it is definitely worthwhile to do the conversion. Chinese EB-3s with priority dates after Sept. 2003 should definitely convert too. 
 
Even considering the time to find a job, file a new labor and I-140, it still looks like that you will get your GC faster than waiting in a not-moving line. The recent history has shown that the visa bulletin can get stuck for a specfic cutoff date for half a year. Besides, EB3s have been and will always be of a lower priority just as someone said in other posts.

You can sign on on behalf of your son and you can place (father/mother) next to it.. This won't need a G28 form.
 
I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?
 
G-28 form says it needs to be filled in case if you use Attorney or Representative. Just wondering whether I need to fill a G-28 form for the above AP renewal application for my son since I am filling Part 9 in his application.

Guys, let me say something here.
 
$5000 for one query is not an unfair amount of money. The reason I say this is because I know a thing or two about writing quality queries, I have done that for the last 6 years of my 9 year career querying the heck out of Oracle CRM.
 
It does take time to write queries and the time it takes depends on how many pieces of information you want to bring together. The wider your spreadsheet is for the final output, the more islands of data need to be connected to fetch that output. Those who are familiar with SQL would know that I am talking about going thru potentially 20-25 tables and joining them to get data. This is probably not going to be a select * from 485_cases kind of query. If it takes 100 hours of time to write such a query, at $50 per hour of programming time, it could be 5000. Most likely it may be fewer hours if they have a programmer with knowledge on staff.
 
The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.
 
And on that note, thanks to "Needhelp!" for shining some light on USCIS process thru her FOIA.

People think best in their native language, that�s why Japanese, Chinese, Americans or the Europeans progressed faster with all the challenges. I think India should give opportunity for every language not just Hindi and English to go maximize once potential. For historical reasons I think every Indian has the duty to preserve all our languages and heritage. Instead of confusing people with mandates, we should have more options. On personal note I like Tamil even though I am not a tamilian, because it is the only international, oldest living and a classical language from India.

Hi all,
Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
I only have a copy of the H1B approval notice.
A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.
 
My questions are:
1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?

4. The new company plans to do premium processing, so if all goes well, can I start working with them as soon as the receipt notice comes in, or do I have to wait till I have the approval notice in hand?
5. Can the consultancy cause any problems for me with respect to my H1B? Is there any way they can find out about this and revoke my H1B?

Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
I only have a copy of the H1B approval notice.
A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.
My questions are:
1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?

I recently applied under 0213. I agree process is not as complicated as it sounds also I am not sure what value add a lawyer will do apart from keying information from you in the forms. My suggestion - do it on your own. Think of something that is unique, gets media attention, something that has not been done, but conveys the message in a very subtle way and yet is very powerful and will create a lump in the throat.
Free math turoring, free SAT preperation classes, you get the idea....
 
Good idea, do something constructive and get media attention. This solves multiple purposes, media attention, best use of time, and would also convey a positive message.
