Below is part of a message I posted in another discussion, but this deserves it own discussion. If you are a legal resident of the US, such as an H4, even if you are a child, and you have an ITIN, you can get a Social Security Number, because that is the only way to get the Economic Stimulus Payment.
 
Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. You letter should refer to the laws and statutes cited below.
 
The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:
 
20 C.F.R. � 422.104(a)(3)
 
(i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

The following are your words, aren't they? I am not sure how anyone could read this anything other than a suggestion that people in ROW category are unskilled and a worker from a oversubscribed country is skilled. You may be the most skilled, intelligent and smart person around here but rest of us can at least read and gather what you are trying to say.
 
I have nothing against you but I wouldn't want people calling ROW folks unskilled. I know you were talking about EB3 ROW but there are ton of engineers, software designers, and many more who applied in EB3 (some by skill sets, some by force, and some by choice). They are not unskilled people by any stretch of imagination.

I thought about that as well.
In my home country, you are *supposed* to list your age on your resume. I am not kidding. They don't consider your resume if you don't put your age there. If I go back there in few years from now (I am 34 now), I am not sure I would be successful there anymore.
 
Folks, we are in a very difficult situation. Our careers are in grave danger. I was planning to wait for GC to let potential employers pay my masters degree, but no way. I already submitted the paperwork to resume the sucker MBA this Fall and pay the whole thing from my pockets. Either that or I should trigger AC21 very soon.
 
If the October visa bulletin shows EB3 World stagnated or retrogressed, you can bet a Starbucks coffee I will be looking for another job/AC21 very fast.
 
 
 
 
 
 
Some people advise to wait and watch and some people ask to do something else. I would like to say one thing and it is purely my perspective. People who are waiting inline for 8-10years does not know when they will be getting their GC in hand. May be in next four to five years. By that time on average their age will be around 35-45.

Did you had any vision for your career when you started your GC and life?
 
Do you have the same vision now for your career and life?
 
Did you feel you and your family have sacrified enough in your personel life for this stupid GC?
 
IF YOU SAY I HAVE DECIDED TO GO BACK TO MY HOME COUNTRY:
 
Do you think you will get a managerial job if you go back to india at the age of 40 when you could see guys @30 doing that job with ease and with better experience?
 
Do you think becos of 10+years of expereince in programming field, indian companies will recruit you for managerial job?
 
Are you willing to work in India as a programmer with 10+ years of US exp under a 25-30 year old team lead or PM ?
 
If you say YES , YES , YES for all the above, do you think any indian company will recruit a programmer at the age of 40? forget about the salary you are going to ask for your exp which they will never accept.
 
So at the end if you wait long enough for GC, then it is better to wait here until you get it. At least you can save your life though you have to start your career from -10years. If you quit and decide to go back to your homecountry, your life is going to be tough.
 
Options for guys waiting for 8-10years for LC:
1. Try to get PMI Certification, CISA certificaiton.
2. Try to get TOEFL, GMAT scores and keep it ready.
3. Try to get in contacts with most of your friends and manpower agencies in India.
4. If you file for your 485 in next one or one and half years, then proeceed with MBA plans(parttime or full time or executive MBA) in top 25-30 business school.
5. Your waiting will yeild fruit in this country only with MBA as in next 10 years, US will need more managers than programmers to manager all their outsourced projects.
 
6. If you do not have such vision and you are happy with what you are doing now and if your job is secured for next 100years and if you feel that you will be happy in future by doing the same job and OK with other kids going up the ladder stepping on you and if you are ok reporting to them and listening to them, getting bashed by them etc etc, you can very well wait for next 100 years hoping to get GC one day.

I am not talking about guys who are lucky on everthing to get on time including GC.

I really admire that. I feel I missed out on all the satisfaction you get when you are proactive about something.

While we are brainstorming constructive ideas, I would like to suggest some fund raising ideas. ( I have posted this kind of ideas earlier but no solid response.)
 
Instead of strictly relying on funding drives IV should consider alternative source of funding.
 
Here are two most simple ideas
 
1) Start showing Google ads on IV website. I am happy to see click on ads and generate some fund for IV
 
2) IV branded credit card, its very simple Chase/BOA will be happy to sponsor IV credit card and pay 2% back monthly to IV if they can sign up 20,000 new customers.
 
Keep asking for donating fund hits wall everytime, its time to work on alternative ideas.

Nice idea but does anyone honestly think the DOL cares. I am somewhat fortunate that my 2002 labor finally got approved in the middle of 2006. My son is not so lucky since he turned 21 while I was waiting. When my senators office took the matter of my son aging out up with the DOL I was told to put him on an F1 visa and send him to college so he can REMAIN (he wants to LIVE here, big difference) in the United States. These people do NOT care what they are doing to your lives. They do not care that my son has NO path to permanent residency any more and that I have to write the enormous check for his tuition twice each year so that I can still have him in the same country as me and his father. I feel awful for anyone still waiting for their labor certification but at least you will eventually get in line for your green card and will get ahead of those filing now with much later priority dates. You are indeed victims but I just wanted to point out that there are thousands of young adult children who have had their hopes for getting a green card totally shattered by this backlog center fiasco.

Not entirely correct. When as you say this country treats all Employment based immigrants equally, why set quotas, why distinguish between EB1, EB2 EB3 etc. 
The point is there are rules and they tend to favor certain applicants over others in the queue. More education generally does mean more skill. It does not always mean more pay, but this country has decided to use education and work experience as the criterion for EB category allocation.
How can you say all nations have an equal opportunity to immigrate to the USA. That is patently false and you know it. Now you can defend it and say it is the US right to set its rules the way it wishes, and I can respect that, but to say it is equal opportunity is wrong.
 
What I have said all along is that EB immigration is to redound to the benefit of US EMPLOYERS not you or me. That is why the rules were skewed so much in their favor. Now, we agree there has been some abuse in this system, by those this system was meant to help, however its purpose remains intact. The rest of the rules are secondary to this intent, but nevertheless important.
 
The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

I was in a similar boat as you when i filed my I485. I was forced to file 140 premium by itself as they stopped accepting starting july 2 07. So we shipped 140 on 29th june 07.On 5th july 07 my attorney shipped 485 with a FedEx acknowledgement of 140 doc acceptance and entire photo copy set of 140 documents

Dude is absolutely right. There is a lot of support for the cause of the undocumented. Their situation is ever more desperate, and what many people do not understand, because of their numbers and huge contribution to the economy, they pretty much hold this country hostage, because it simply will not be able to survive without them any more. This is why lawmakers are less interested in the cause of legal immigrants.

I used AC21 but was lucky to get RFE only. Thank God.
It is not worth unless you get double or at least 50% rise in pay.
Else don't go that route.
 
Guys who got NOID/Denied 485, quick question.
 
Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?
 
For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?

This is a good first step in this direction after our campaign for FOIA last year. If we can get the data we need, prediction on date movement and getting the clear picture on pending applications should be easy.
 
I personally feel 5K is too much to charge, but if this is what it takes I think we should pursue it. Lobbying for it may have cost more. We need to get more information about this and if everyone agrees we can raise funds and pay for one request to take it forward.

Does the new CIR Bill invalidate AC21...if yes then will it affect people who already have EAD before enactment of the bill.

I don't think i should necessarily agree with this statement. The shortage of manpower is w.r.t US Citizens with specialized skills...hence they recruit specilized people on H1/L1 categories which are known as specialized skilled employees. They won't bother about others unless they hold H/L. 
 
Moreover, they have to think about unemployment issue caused by foreigners. Hence, I think they can't allow anyone work just like that...
 
I can see the most wierd issue with immigration law is that GC Holders can't bring their spouses on any dependent visa just like H4. In that sense, H4 is a bit better than 'foreign spouse of a GC holder'.
