This is yet another example of how the US is happy to tax us and let us finance Social Security, then place us in a similar category to "illegal aliens" when it suits them. I absolutely do not agree that it will do more harm - given the current situation where every country is backlogged in EB3, and EB2 for India/China is also severely backlogged, there is very little chance that India and China can have more than 10000 visas (7% of 140,000) issued in Fy 2006 across all of Eb1/2/3. 
 
Current System
EB1 China/India might benefit a bit because they will be the first ones to get the visas from extra EB1 visas but then, if Specter/Frist's bill passes, many of these EB1's will get a chance to file for 485 anyway.
 
EB2 China/India might also benefit a little bit provided rest of the world leaves something behind.
 
EB3 will not benefit at all as every country is backlogged here.
 
Looking at FY 2005 statistics is very misleading. So, the way things are, any bill is better than no bill at all - at least we have a shot at improving the status quo we are in.
 
Instead of just comparing current situation with future, especially when the future is so unclear, we should try our level best to achieve the following
 
1. Put the clause back
2. Amendment to file 485 after 140 or labor has been approved for certain time but Visa number is not available. Emphasis should be on the total wait time for GC, so that people in BECs do not get screwed.
 
Put all your energy and efforts in achieving these and we will not see retrogression for many years. My goal is not to dissuade people from the comparison - it is a healthy exercise, but now that we know what the pros and cons are, let us work together to solve.

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card
 
I don't think the tech companies are lobbying (strongly enough, if at all) for EB GCs. They are happy as long as H1 quota is increased which I think they will get in one form or the other.

My best guess is that when you created profile in USCIS.gov, probably by mistake you entered wrong receipt# which belongs to some one else. USCIS does not verify if the entered receipt # is belongs to you or not.

Just received email from CRIS regarding I-485 denial notice for both me and my wife.
 
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
 
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
 
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
 
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

How long is your current H1 valid? As far as i know, You can get your H1 extended with the new company till the present H1 date provided the pending LC is not revoked. Normally most companies do not specifically cancel the LC..so you should be fine.
As soon as you join the new company, apply for Perm.

Including the House session and Conference session, if somehow this is pushed beyond October 1st 2007, then the enactment will happen on October 1st 2008. We have to hope for that. That gives best possible window for all BEC, PERM-BEC candidates and people who have not filed their I-140s yet.
 
The impact is on H-1B renewals beyond six years, with the cut-off proposed at six years. The only exception for renewal beyond 6 years is given explicitly to people who applied for immigrant petition. So BEC/PERM-BEC people should apply for I-140 asap.

Here are some of my own personal thoughts:
 
How can one tell a percentage number for something to pass? What kind of data can we base our calculations on?
 
Who said EB3 India will not forward next year? Did DOS say that? An individual lawyer is not Dept. Of State. I would like to see a written proof from DOS saying this so that we can plan ahead.
 
There were many naysayers for the July 2007 bulletin. But IV was able to get it current again. So stop believing in predictions and believe in yourself.

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
 
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
 
I think the consulate officer should ask people that will you behave the same way at an US consulate??
 
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
 
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
 
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left. 
 
when obama made a sexist remark, what did the press do? Nothing. Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.
 
Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy. And such thing is bad for everyone concerned (even the world, because like it on not, what happens in USA doesn't just stay in USA) -- Obama has already demonstrated that he is nothing but a political opportunist. His comments on Israel (I liked his statement, but not his intention) and the eventual recanting, and among many other examples, shows that he is just unqualified to be the President.
 
And for the records, McCain in not running for the job just based on the fact that he was shot down. He has considerable amount of experience working in the Senate and knowledge of world issues, and American issues too.
 
Give me a break. McCain is running a honorable campaign and Obama is running a dishonoSrable campaign. Can you give me an example close to the "teaching sex to kinder garden" sleazy ad from McCain camp?
What is the sexiest remark? Can you explain? Media pounding on Republican? Oh yeah we saw them pounding on Bush when he ran in 2004. I remember how the media ran stories of kerry shot himself in the foot to become president. And all those pundits asking 'who do you want to have beer with' stupid questions. And I remember the left leaning media pounding on the non issue pastor wright.
Obama is a political opportunist while McCain is a saint? Do you know who said this "I didn't decide to run for president to start a national crusade for the political reforms I believed in or to run a campaign as if it were some grand act of patriotism. In truth, I wanted to be president because it had become my ambition to become president. I was sixty-two years old when I made the decision, and I thought it was my one shot at the prize". John McCain. And what does he say now "Even in retrospect, he would choose the path of retreat and failure for America over the path of success and victory. Behind all of these claims and positions by Senator Obama lies the ambition to be president. What’s missing is the judgment to be commander in chief." He is your saint?
Saint or no saint, we don't want 'drill baby drill" guys and "God is running this war" nuts in the white house. You will have more problems in the economy and useless debates on abortions. We need to push them in the right direction and demand them they carry through their promises. We may not have the right to vote, but the outcome of this election will impact us and around the world.

As we have been learning, majority of the American public (including your neighbors) associate immigration reform with illegal immigration. Now if you ask them politely and ask whether they support immigration for highly skilled/highly educated individuals (already in the US working), you will hear no protests. 
 
So basically, it boils down to awareness. When we have people affected by retrogression, unaware of the issues, how can we expect a lawmaker to know the inner details?
