If you read my post carefully, I am suggesting this 'in addition' to what's already on IV's agenda. Why can't we work on this item in conjunction to what's already being worked on? I have started preparing a fraud list from a bunch of websites like desicrunch.com. I noticed that almost 90% of firms reported there are fraud firms and it makes me wonder about the efficiency of local authorities. Also I don't see how targeting blood sucking desi firms would feed the anti-immigrant trolls. I would think we Indians would benefit the most since it would increase our credibility in general. Thanks for considering this idea at least. I would like to know other people's thoughts based on my clarification here. This drive might clean up cases freeing up visa numbers for genuine EB cases from India. Why should I be in line with crooks ahead of me? It doesn't make sense whatsoever.
 
And yes, my contribution to IV so far as been $1000 and involvement in other drives. I hope this amendment will pass as it was proposed by important senators like, Chairman of Judiciary committee Mr Leahy, Mr Cornyn, Mr Hatch. This alters the equation completely. If it passes, the total EB & Merit based visas are 387,000. The total EB visas as per old system will be 230K.
 
Merit based system: 247K (147 for newly created point based +90 K to clear backlogs)
Employer Sponsored System (as per amendment) = 140K
 
Therefore 230K is available as per old EB system. Apart from that, most of the EB1 and EB2 guys and the dependents of EB visa holders will be exempted from numerical limitations. This is the proposal we should support.
 
So you mean to say that 230K will be for backlog/year and the people who already filed in the old system will also be exempt from the cap if they belong to certain EB1 and EB2.
 
If the above is true then we should be in good shape as % per eb category is increased and masters exempt.

I am not wealthy, I don't have a ton of disposable cash lying around. I just want my green card, and I want it now. Actually no, I wanted it yesterday.

Don't waste time by calling National Call service center. They all are dumb !! They don't know anything. They just read the on line status of our case, which 8 year kid can do. 
 
 
According to the first guy I talked to, one has already been assigned upon the start of processing of the case.
 
I just called again and the lady was completely clueless about the whole July 2 fiasco. I will try again in another hour and hopefully I won't get the village idiot again.
 
For anyone interested in calling themselves here is the info: 1-800-375-5283 options 1, 2, 3 (and possibly 6 after that-I can't remember).

I�m working for company A and company B has sponsored my GC as future employee and also did a H1 transfer from A but got a big RFE. Now company C is ready to do H1 transfer. Is it a good idea to do so or would get into problems as GC is in process through B? We did I-140 & I-485 concurrent filing and got our EAD�s approved but I-140 is still in pending status. I heard that using EAD is not a good idea when I-140 is pending.
My Attorney is sending a response to RFE but I�m not sure whether it gets approved or not. What happens if B transfer gets approved and would choose to work with B and not use C at all (if it gets approved)?
In the other way, If C gets approved and choose to work with them as the H1 with A expires pretty soon (got to move out) can I comeback to B with a fresh (another) H1 transfer. Please suggest what is the best to do at this time?

With all your wishes and almighty blessings today I got MTR approval and I485 into reopen status.
 
My earlier employer revoked I 140 in Sept 08 . Applied MTR in OCT and got MTR approval and 485 reopened notification today.
However online still not updated - may be site is still down.

Now after completing my studies, can I use same H1 petition from Old Quota or I have to apply again in Fresh H1 Quota.

I have my H1B from company A.Now I am planning to have H1 transfer to company B. I don't have a record of the experience letters(2000 - 2003) I submitted when I filed my H1b through company A.
 
Now when I am applying for H1 transfer from company B can I just submit the experince letters from 2004-2007 including the letter from company A so that they don't contradict with what I have submitted before??.
 
I would also be submitting my education evaluation,w2s,recent paystubs etc. The problem is only with my previous experience letters.
 
please let me know if this is okay or can there be a problem.Any help would be greatly appreciated. This is urgent for me!!!

Back to the numbers game - .... The country quotas could disappear, and the overal limit could be increased, but without reforming the actual processing side the speed of approval will not change.

Please provide good reasons to purse EB3 to EB2 thru another company. I am not getting enough motivation or strong points to port from EB3 to EB2. Please provide serious input. I will definetly purse new job for porting. 
 
Some of the reasons in my mind to go for EB2 thru new job:
1. Immigration freedom (like financial freedom)
2. All new and old eb2 filers are going to get green card before me. I am not jelous about them if I have filed my case recently. But my filing happend 7 years back. So, I should really think about it but not in terms of jealous.. it could be shame on my part...
3. Immigration rules and regulation fluctuations..
4. Early GC means, early citizenship. Chance to survive here in Federal, Navy, Army IT jobs with security clearnace if get citizenship early. Otherwise, govt. sector will also be saturated. My position is taken away just because of not gettting early GC.. Too much think ah!!

1. Unneccearily touching the immigration process one more time and is kind of risky when INS dig deep into and do micro auditing the old and new filings. Though my case is strong,, they some time create tensions... you know what I am talking about..

3. After spending lot of years in North East winter weather, I moved to NC. Good place in terms of everything. If I start looking for job, not sure whether I get here or somewhere in cold.
 
 
Unable to decide about porting. Please provide your serious input so that I get good motivation. I have MS and have excellent skills in J2EE/WebSphere world. Not able to buy home due this EB3/EB2 porting in my mind. Because location change may happen if I decided to go for porting and place change happens due to that. yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.
