Hi,
I had invoked AC21 and informed usc thru my old attorney.
Now Frago...is filing my EAD,AP extensions and asking me to file G28 for AP and EAD only.
They agreed to keep 485 G28 as is so that old attorney will take care of it.
Do you see any issues here?

If you do some more research before writing you will realize that H1C are limited to 500 visas a year and the conditions for selecting the hospitals allowed to sponsor is so stringent only 14 hospitals or so in all US qualify. Here is some more info.

Many posts on this thread suggest that there is no H1B type visa for nurses and so they have to come on only greencard; and that is why Health lobby is trying hard to GRAB 90K unused visas (note: I consider this as a grab because from skill/CIR bills; we are trying to recapture unused visas and make them available to ALL EB immigrants rather than allocating them to one special group). But according to this news item on immigration-law there seems a non-immigrant visa H1C available for nurses. Is this true? am I misreading this?

The Nursing Relief for Disadvantaged Areas Reauthorization Act of 2005 took effect December 20, 2006. The Act reauthorized the H-1C nonimmigrant nurses program, a program originally created by the Nursing Relief for Disadvantaged Areas Act of 1999. Under this program, eligible hospitals file attestations with the Department of Labor, Office of Foreign Labor Certification which, if approved, will support nonimmigrant worker petitions filed with the Department of Homeland Security, U.S. Citizenship and Immigration Services. The Department of Health and Human Services has informed the Office of Foreign Labor Certification that the same hospitals eligible for the original program continue to be eligible. These were listed in the Department of Labor's Interim Final Rule implementing its portion of the H-1C program published on August 22, 2000 (65 Fed. Reg. 51138). The Employment and Training Administration, under the authority of the new public law, is reinstating the H-1C labor attestation program and is accepting applications by qualified hospitals. Eligible hospitals should be advised that the now-expired OFLC form (ETA 9081), Attestations by Facilities Temporarily Employing H-1C Nonimmigrant Aliens as Registered Nurses, has not been authorized by the Office of Management and Budget (OMB) for current use. However, the OFLC will accept applications using the expired form until a new form is approved by the OMB. The attestations are made enforceable by the 2005 Act. Did anybody else saw this problem?

Hi,
I lost my jon w/big software consultancy. I found another project and then applied for H1-B transfer with Indian consulting company. Its been almost 1 month since new company have filed for H1-B transfer and renewal (my H1-B was expring on July 6th, 2009).
so far, i've not received any H1-B recipt. I'm worried about it. I'm also getting married in the last w/e of Nov, 2009. Is it a good idea to file for Premimum processing.

Who are they?, they do not have any voice or vote anywhere. They are ILLEGAL, they broke the law.
Congress and Senate are dominated by Democrats. If they think that is best for USA what is your problem? Wherever our interests meet, we need to support other things. Also if amnesty (for lack of better words) is given by US Govt, (with proper border enforcement), then they will not be illegals. Hope you are getting big picture.
I personally had many meetings, they echoed the opinion that we are doing the right thing. That is the way things work in the capital. And they have very great opnion of Patton Boggs.

I filed I-140 on July 5, and was hoping to get the receipt by this week because as per the press release ( dated 7/13), NSC was supposed to be time complaint with regards to I-140 receipt date by 7/18/2007. But they again changed to 8/1/2007. You never know they will NOT change it again!

I am sure it could be a mistake from CIS, you should be fine after your MTR submission.
I myself changed employer after 180 days, I am working for second employer now after my GC sopnsered employer. I have not informed CIS yet, planning to do now as I got kind of good and stable job and company.
Initinally after 180 days I have joined a small consulting company and working for a client and then after some time client offered a fulltime employment with same titile and responsibilties. I have joined the client and willing to send AC21 letter now, anybody any sugessions would help me here.

Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

I think lot of people feeling that it is very difficult to pass Senate version CIR(May be they will pass house version now and Senate version later).
That might be reason for Skil bill. But any bill which has permanent increase in immigration will face a big opposition and delay of few weeks to few months to pass. In past 2000 the h1 increase to 195k was passed because that was temporary and eventually Cap was back to 65k. Similarly for GC unused other country quota was used to India and China. So everyone got a relief without much oppostion. Beacuse they were able to convince all congress members that no change in Cap of immigration. But skil bill is having permanent increase of GC and H1 and also exemptions will increase further immigration numbers. Though it is a permanent solution to resolve retrogession of pd it will face big oppostion from anti immigrants.
