Can I change to different employer while the i140 is pending and also keep the PD. What i would like to do is..i want to change to a different employer and ask the present employer to keep the i-140 process as it is.
Is it ok if the i-140 gets approved while i no longer work for that company. I understand if i get any RFE, then employer need to respond accordingly.

I am a Indian citizen working in the technology sector on a H1B Visa. My 6 years on H1b in US are over. I have a approved I-140 and based on that I have a H1b extension for another ~2.5 years. My wife also works on a H1B Visa. I plan to go to school in the US for an MBA degree and will need to move to F1 Visa (student). Can I legally work in US after my education is complete in approximately 2 years time? Or do I need to move out of US before starting employment on either H1B or OPT (If these are allowed for MBA students)?

I have been reading a lot of late about troubles/Denials given to H1B visa holders at POE.
I have been in US for few years now on H1 working as Marketing Manager and traveled smoothly so far. Planning for a short vacation to Europe. Should I?

I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

I also understand and have developed AfterEffects peices for web publishing purposes. So if you need Flash animation, I can do that too. My lastest work was a FLV and Flash intro peice for Enyce.

My previous employer filed EB2 labor for me. I left the job after getting 140 approved so that I will hold the priority date.
The new employer, as per their policy is planning to file labor application in EB3 category and NOT in EB2 category.
My question is, the way I post PD from old approved 140, do I port the EB2 category also? ie will my PD get compared with EB2 PD or EB3 PD when it comes to filing 485?

I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:
1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)
2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?
Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.
Need help ASAP. Thanks a lot.

Hi, this might not be the right forum for my question but at least I am hoping that I can either can an answer or steered to the correct direction. So I quit my job in the US about a month ago because I was immigrating to another country. My job was located in Arizona and I immigrated to Israel. My company knew this was the reason I was quitting. So I am wondering if I should have received a severance package or unemployment benefits because of the reason of immigrating to another country.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.
