Do you know how long it takes for the SWA order to be posted after a job order has been requested with the SWA?
Is it immediate or does it take some time for the SWA to process the job order and then post it?
Also do you know where we can see the job order after it has been posted? Is there a public site where we can see the jobs?
Any response is greatly appreciated, especially if you know about mass.

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.

Hi All,
I have a question regarding my wife's H1B Status.
My wife got H1B stamped in hyderabad consulate last year. Due to recession, she applied for H4 to join me in US, got H4 stamping in hyderabad, during which
H1 Visa was cancelled[expected..]. we have H1B Petition docs which says it is valid for 3 years. My wife came to US on H4.
Now can't she apply for Change of status from H4 to H1 as we have petition docs, which are valid for 3 years?
when contacted the actual employer, they said, when H1 visa is cancelled, it means, H1B petition also cancelled. Is it true?
Please suggest.
Thanks for your time.

Thank you. I checked it out. My nephew (7yrs) also plans to come for 3 weeks with my in laws. He has never been to the US before, and his parents are not coming either. The site mentioned that parents visa papers also have to be attached, I am not sure what this means. (His parents have never applied for the visa)
Your inputs are much appreciated. Thanks

Can I apply for AP renewal now even if my current AP expires in mid Oct 2009 or should I wait until the expiration date is 90 or 120 days (like H1 renewal).
My EAD expired last year and I have not renewed it, so I should be good on that (I am working on H1) but had a question on AP.
Thanks in advance

I am currently on H1B with a temp status (B1) and in-between jobs. My partner is in the process of becoming a US citizen. He has had his Green Card for years and obtained it through his ex-spouse's job while they were still married. He has been divorced for about a year now and started the citizenship application process a couple of months ago. We are thinking of getting married after he gets his citizenship. My question is: does it matter if we get married before or after he obtains his citizenship? We heard rumors that a previous marriage might be a factor in whether I will be able to obtain a Green Card. Thank you very much in advance for your help!

I am US citizen since March 2009. Husband just received an interview notice for August 11 after having filed all required documents and application for I-485 adjustmnent of status. Along with other documents, we submitted a xerox copy of his I-94 which he overstayed. Unfortunately, he lost the original. My concern is, the interview notice states he is to bring the original I-94, which he no longer has. He can prove however the date of his last entry to the US, as he still has a stamp in his passport with admission date, a sticker on his passport cover for baggage and I can probably dig up his boarding pass. Again - we also made a xerox copy of both sides of I-94 when we still had it. What do I do? Should I get a duplicate? Or is the xerox enough for the interview? I would hate his application to be denied because of this. Please let me know if you had a similar experience or any advice on what I should do.

My law school roommate and long time friend Henry Olsen is the vice president of the conservative think tank the American Enterprise Institute. He's written an essay for the National Review entitled "The Way of the Whigs" and it talks about the danger the GOP faces in terms of long term survival. This might seem strange given the recent polling problems the Democrats have experienced, but Henry writes that there are long term forces at work that Republicans need to heed. One is the growing Hispanic electorate which has shifted decidedly toward the Democrats over the last two election cycles....

None of my friends from UCLA Law School, class of 1973, went into immigration law. Corporate law, personal injury law and real estate law were all far more lucrative. If you are looking for a multi-million dollar settlement, immigration law is not for you. So why do we immigration lawyers do what we do? Having spent over half of my life practicing immigration law, I can tell you that I consider myself to be very fortunate. The satisfaction that I get from meeting and helping immigrants from around the world makes it worthwhile. Let me explain myself by telling you...

Below is my situation regarding the change of status. Could you please help on this
My Wife Has entered US with H4 on April 16th 2006
Her H1 Visa Approved for her on : Oct 1st 2007
Worked on H1 with an Employer: May 2008 to Oct 2008
Later: From Oct 2008 to Now -- NO PAYSTUBS
Her employer advises her to cancel her H1 and change back to H4. Will there be any problem with this? And how do we go about it.
Also to add to the problem, I have actually filed my H1Visa extension which expires on May 09 and got an RFE on the same. My Employer is responding to the same. Based on this case, How do I go about applying for my wifes change of status
Would appreciate your help on this

"It was an unusual sign, even for a restaurant here along the Maine coast, where seasonal home-grown businesses are a way of life.
Closed. Gone to try and get a new visa, read the hand-scrawled message taped inside the window of Lauras Kitchen, a cozy eatery that specialized in corned beef hash and omelets and where the tiny tables were still set with brightly colored napkins. Hope to see you in the spring. Dean & Laura.

I've attended hundreds of meetings of immigration lawyers in my career. Many of them have exhibited characteristics of 12-step groups in which we formed circles of victimhood, and "admitted that we were powerless over [INS, USCIS, DOL, State, etc.]and that our lives had become unmanageable." Many of these sessions disgusted me because of the excess of whining complaints over action. Too often immigration lawyers are wont to complain and play victim, but rarely do they model the fictional TV executive, Howard Beale in the movie, Network ("I'M AS MAD AS HELL, AND I'M NOT GOING TO TAKE THIS ANYMORE!"). I...
