I'm working on L1 & have H1 petition without COS.
Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?
Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.
Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?
If not, is there any other option?
Please reply. Help appreciated.

I was searching on all programmer salary's on SalaryList.com (http://salarylist.com), it looks like we are much higher than the other majors, business analyst, finance analyst. So if I want to do AC21, in current condition, should I keep same salary? Several companies I talk to can only match now

Hi,
I"m currently working for a TARP company and my I-94 date is Aug 2009. I still have 3 years left on my H1B.
I've got an offer from another bank (non-TARP) and they have filed for my H1 transfer.
a) Any idea what the wait times are these days?
b) Anybody seen problems with H1B transfers these days?
c) There might be a 1 week overlap (pay) between my current company and my future company. is that OK? e.g. My join date in the new company will be Feb 23rd and my notice date will be Feb 28th in my current company.
cheers

Interim EAD's are no longer an option since Sep 2006
In case of emergency travel it is possible to get AP from local office
But in case of extreme emergency like death in the family, funeral etc

It should not be a problem. Our GC's were approved when we were overseas and we came in using AP's.
Try to bring print outs of approval from USCIS website. If you have that, they will admit you as a PR. I tried explaining but they didn't listen and used the AP. If you have a printout they willl stamp your passport as a PR and let you in.

All,
I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.
I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.
Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.
Please Advise.

Immigration policies at today's USCIS may change in a flash. They can be announced and then, without forewarning or explanation, withdrawn in the milliseconds it takes for the agency's webmaster at www.uscis.gov to push the upload and delete buttons. At times they are as reliable and ephemeral as the inducements of a carnival barker. Take for example a January 19, 2010 policy memo, "Signatures on Applications and Petitions Filed with USCIS" (penned by USCIS Acting Deputy Director, Lauren Kielsmeier). The memo appeared evanescently and then, as Ron Ziegler, Richard Nixon's former press secretary in the Watergate era, might have said,...

Folks,
I have a question about a new H1-B application while I-485 is pending. If I-485 is pending and the person is currently working on EAD with expired H1-B, is there a requirement that the person has to leave the country to apply for a new H1-B based on pending I-485? If yes, will it affect the green card process negatively?
My attorney says that as there was a gap in H1 status, one has to leave the country for a new H1 application, even though it is with the same employer.

Hi Everyone,
I have completed my 6yrs H1-B and currently have 1yr h1-B extension until Jan, 2010. However, my PERM application for Green card was filed on Jan 2008 and is still on hold.
Given the above case can I still transfer my H1-B to a new employer with 3yr extension? I have heard that after the 6yr period H1-B is over sometimes there are cases where 3-yr or new 6yr period H1-B are issued. Can someone advice me whats the best scenario for me?
Thanks.

GC approvals are getting lesser & lesser...
Spillover is minus? How's that possible - genius? So - are they revoking GCs already issued?

Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?
Thanks

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

No one from EB3 category posting their success story of geting a GC recently. What does that mean, VB PD is just foolling us and making you to go crazy.
Its like Titanic ship, everyone wants to get a boat. Unless you fight to get a boat you will not get. We are treated the way how Titanic treated to its 3rd class passengers.
Bring a chair on your back, talk to your wife, freinds, relativs, parents and child. "Whether sending a letter for good cause will harm you". Everyone will say no. Then why are you waiting.
Support IV. IV is just you. You donot help IV's dreame to die. IV is me and you.

It's not official, but it sounds like the Obama Administration is getting ready to make some news. Secretary Clinton told CBS News today: Well, we have, as you know, many Haitian Americans. Most are here legally. Some are not documented. And the Obama administration is taking steps to make sure that people are given some temporary status so that we dont compound the problem that we face in Haiti. That sounds like Temporary Protected Status or Deferred Enforced Departure.
