I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.
I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.
I have taken a infopass to discuss this with USCIS to get an update.
One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.
How do I fix this? Please suggest.

I filed my I-485 application with vermont and I live in WA, according to the instruction form , I765 should be sent to Nebraska
1. Where should I send the paper filing for EAD ot Nebraska or Vermont.
2. Should I make the check payable to USCIS or Department of Homeland security.

I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.
Normally How long it take to get EAD from Texas Service center. ??
Any idea. ??
Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

Nikon is taking their time with this one, as they're taking their time with the WT-3 transmitter for the D200. I am interested, but by now I've invested a bit too heavily in a DNG-based workflow by converting everything to DNG and attaching IPTC metadata, to consider Capture NX as a serious contender for my workflow. Though, I do imagine that I'd use it for those rare times when I need a really high quality conversion for very large printing.

Hello,
I am on H1 B and wife is on H4. H1B is expiring in Nov 2009 and my employer is going to file for extn. My wife is currently doing her Masters on H4. Need some advise to here
1) If I apply for extn (H1 & H4) within next 2 weeks it will take atleast another 3 months before I will come to know the decision. Nowadays lot of H1B extensions are getting rejected. Will it be a good idea to move my wife's status to F1 and not apply for her H4 extn..?
or
2) Should I wait for my decision on extension and if it gets rejected then apply for F1
or
3) Apply both i.e. apply for extension and simultaneously for H4 to F1. Any issues with this approach?
I don't have constraints on paying fees on H4 or F1. All I want is my wife should be able to continue her studies. I am working in an Indian company, so even if my extn gets rejected, I will go back to and continue work, but still want my wife to continue studies.
Appreciate your help.

Perm applied in May 2007 . Got audit in June . Responded within a week. No response since then. Company lawyer approached DOL 3 times checking for the labor status. No response.
Is it possible to resubmit the perm application retaining old date. Any suggestion if that might help.

I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:
Have H1B active with current employer till Feb 2009
Just got my priority date current - EB2 July 2004 for India
I-140 approved, I-485 and I-140 filed last year receipt date Sept 2007
Questions:
How can I get new EAd now?
I can continune working on H1B correct?
Any impact on my 485 application that now will process due to PD being current?
PLEASE HELP. I am confused and worried a bit.

In my LCA(H1B) Prevailing wage is $ 55K & in my Labor(PERM) application Prevailing wage is $ 65K.
My labor(PERM) has been approved & I-140 is in process at TSC.
My question is
This diffrence between LCA mentioned prevailing wage(i.e. $55K) & Labor(PERM) prevailing wage(i.e. $65K) going to create any problem at stage of I-140 or later in I-485??
I am getting paid as mentioned in LCA i.e. $55K.
I will greatly appreciate response.

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.
